Updated: Hearing Delayed for Man Charged With San Marino Rape, Murder-for-Hire

The preliminary hearing for Brian William Harrington of Pasadena has been postponed. A preliminary hearing date setting will take place on Feb. 1.

but the hearing was delayed Tuesday during a proceeding at the Alhambra Courthouse.

Los Angeles County Deputy District Attorney Jose Gonzalez--filling in for Deputy DA Amy Murphy--and defense attorney Anthony Brooklier agreed to hold a preliminary hearing setting in Alhambra on Feb. 1.

Brooklier told Patch Tuesday that he anticipates the preliminary hearing will take place within 10 court days of Feb. 1, not counting weekends or holidays.

"I'm not at liberty to discuss the case at this point," said Brooklier, regarding specific defense.

About 200 pages of discovery have been presented to Brooklier thus far, he said.

"We just got an interview of Larry Montez; he was interviewed over the course of this investigation," said Brooklier. "Apparently there's more interviews on the way. No defense attorney will do a prelim without all the discovery."

Montez told police that Harrington hired him while the two were in prison to kill the San Marino woman Harrington is charged with raping, according to the criminal complaint charging Harrington.

San Marino Detective Henry Todd told Patch that when he was informed by another police department about Montez informing on Harrington, the police department denied Montez was given any kind of deal in exchange for the information.

"He came forth out of the goodness of his heart," said Todd, who is investigating the case against Harrington.

Montez remains in jail and was subpoenaed to appear at Tuesday's proceeding, but did not show, Gonzalez told presiding Judge Jared Moses on Tuesday.

Montez is set to appear at the Feb. 1 proceeding. Moses instilled an order for Montez to keep away from Harrington until that time.
